This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website, mobile application, and Vertbox device (collectively, the “Services”). By using our Services, you agree to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide to Us

  • Account Information: Name, email address, phone number, password, and profile photo when you create an account.
  • Identity Verification: Government-issued ID, date of birth, and selfie for identity verification purposes.
  • Vehicle Information: Make, model, year, and photos of your moped, scooter, or motorcycle.
  • Payment Information: Bank account details, Cash App handle, or cryptocurrency wallet address for earnings disbursements. We do not store full card numbers; payment processing is handled by third-party processors.
  • Communications: Any messages, feedback, or support requests you send to us.

1.2 Information Collected Automatically

  • GPS Location Data: Your Vertbox device continuously collects and transmits GPS coordinates while powered on. This data is used to serve geo-targeted advertisements, calculate ad impressions, verify active riding periods, and process your earnings.
  • Device Data: Vertbox hardware identifier, battery level, firmware version, connection status, and device health diagnostics.
  • Riding Data: Route paths, speed, distance, start/end times, and trip frequency derived from GPS data.
  • Ad Performance Data: Number of ad impressions served, ad content displayed, timestamps and locations of each ad display.
  • Usage Data: Pages visited, features used, session duration, click patterns, and interaction data within our app and website.
  • Device Information: Mobile device type, operating system, browser type, IP address, and device identifiers when using our app or website.

1.3 Information from Third Parties

  • Delivery Platform Data: If you choose to integrate with delivery platforms, we may receive confirmation of your active status. We do not receive your delivery earnings or customer data from these platforms.
  • Background Check Providers: If required, we may use third-party services to verify your identity and driving history.
  • Advertising Partners: Advertisers may provide ad creative assets, targeting parameters, and campaign instructions.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Vertbox rental Services
  • Process rider applications and verify eligibility
  • Match you with relevant geo-targeted advertising campaigns
  • Track and calculate your ad impression earnings accurately
  • Process weekly earnings disbursements to your designated payment method
  • Provide the rider dashboard with real-time earnings and performance data
  • Monitor Vertbox device health, battery status, and security
  • Detect, prevent, and address fraud, theft, or abuse of the Services
  • Communicate with you about your account, earnings, device status, and product updates
  • Improve and optimize our Services, ad targeting algorithms, and rider experience
  • Comply with legal obligations and respond to lawful requests
  • Aggregate and anonymize data for analytics and business intelligence purposes

3. How We Share Your Information

3.1 Advertising Partners

We share anonymized, aggregated location and impression data with advertisers to confirm campaign performance. Advertisers do not receive your personal identity, name, contact information, or precise individual GPS traces.

3.2 Service Providers

We share information with third-party vendors who perform services on our behalf, including:

  • Payment processors for earnings disbursements
  • Cloud hosting and data storage providers
  • Identity verification and background check services
  • GPS and connectivity service providers
  • Analytics and performance monitoring tools
  • Customer support platforms

3.3 Legal Requirements

We may disclose your information if required to do so by law, in response to a valid legal request (such as a subpoena, court order, or warrant), or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, investigate fraud, or respond to a government request.

3.4 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on our website before your information becomes subject to a different privacy policy.

4. GPS Location Data: What You Should Know

GPS location data is central to how the Vertbox works. Here's what you should understand:

  • Continuous Collection: While your Vertbox is powered on, it collects and transmits your GPS location in real-time.
  • Precision: Location data is accurate to within approximately 10-30 meters.
  • Storage: Raw GPS data is retained for 90 days. Aggregated and anonymized location data may be retained indefinitely for analytics.
  • Ads Are Location-Based: The ads displayed on your Vertbox are determined by your current location. Riding through Buckhead will show different ads than riding through Decatur.
  • You Cannot Opt Out of GPS Collection: GPS collection is required for the Vertbox to function. If you do not want your location collected, do not use the Vertbox.
  • Law Enforcement: We may be required to disclose GPS data to law enforcement pursuant to a valid legal process.

5. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information, including:

  • Encryption of data in transit (TLS/SSL) and at rest (AES-256)
  • Access controls and authentication requirements for internal systems
  • Regular security assessments and penetration testing
  • Secure data center facilities for physical infrastructure

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you Services. If you terminate your account:

  • Account information is deleted within 60 days
  • GPS and riding data is deleted within 90 days
  • Earnings records are retained for 3 years for tax and legal compliance
  • Anonymized analytics data may be retained indefinitely

7. Your Rights

Depending on your location, you may have certain rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete information
  • Deletion: Request deletion of your personal information, subject to legal retention requirements
  • Data Portability: Request your data in a structured, machine-readable format
  • Opt-Out of Communications: Unsubscribe from marketing communications at any time (transactional communications regarding earnings and device status cannot be opted out of)

Our Services are not intended for individuals under 18 years of age. We do not knowingly collect personal information from children. If we become aware that we have collected information from a child under 18, we will take steps to delete that information.

  • The right to know what personal information we collect and how it is used
  • The right to request deletion of your personal information
  • The right to opt out of the sale of your personal information (we do not sell your personal information)
